PRIVACY STATEMENT 

Al Manaf International Manpower Corp. (“Al Manaf”, “we”, “us” or “our”) supplies high-skilled Filipino workers for the world market. We provide unparalleled human-resourced solutions for various employment abroad. 

We take pride in conducting business responsibly and ethically, thus, we pursue our business goals and provide our services, we ensure that the personal data we process are safeguarded and the data privacy rights of the individuals whose data we process are upheld, placing highest regard on the data privacy and security of our stakeholders.

We ensure that the data privacy principles are embedded in our processes whenever we handle the Personal Data of our stakeholders in accordance with the requirements of the Data Privacy Act of 2012 (DPA) and other related laws.

WHO WE ARE

Al Manaf provides human resource services by supplying Filipino Manpower for the world market. When we use the term “Service(s)” we mean collectively:

1.  The service and information provided through our website owned and controlled by us, including the website at https://almanaf.ph/ (the “Site(s)”);

2.  The provision of services such as sourcing of Filipino candidates and assisting in document processing for the foreign principals and the candidates.

3.  Our marketing and business development activities (“Marketing”).

THIS PRIVACY NOTICE

This Privacy Notice describes how we collect, use, store, disclose, dispose and protect your Personal Data as we pursue our advocacy for our members and provide our Services.

The words “Personal Data”, “Personal Information”, “Sensitive Personal Information”, “Processing of Personal Data”, and other related terminologies in this Privacy Notice are used in the same context as they are found in the DPA, its Implementing Rules and Regulations (IRR) and other relevant National Privacy Commission (NPC) issuances and other applicable data privacy laws (collectively “Data Privacy Laws”).

·  Personal Data refers to both personal and sensitive personal information.

·  Personal Information is any information or set of information that can be used to identify an individual or can reasonably and directly identify an individual.

·  Sensitive Personal Information is any information about individual’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations; individual’s health or education; about any criminal, civil or administrative proceeding of an individual; unique government issued identifiers; and those established by law as classified, as defined under applicable Data Privacy Laws.

·  Processing of Personal Data refers to any operation or any set of operations performed upon personal data including, but not limited to, the collection, use, storage, disclosure or disposal.

This Privacy Notice does not cover the practices of companies we do not own or control or people we do not manage and this Privacy Notice does not apply to any third-party sites that may link to or be accessible from our Sites.

OUR BASIS FOR PROCESSING YOUR PERSONAL DATA

As we conduct our business and offer our services, we may process your Personal Data in accordance with the following lawful basis: 

1.  Consent. Your consent, which you may withdraw anytime unless there is other basis for processing.

2.  Contract. To allow us to fulfill our obligations and exercise our rights under relevant contracts.

3.  Lawful Rights. To protect our lawful rights and interests in court proceedings or to establish, exercise or defend legal claims.

4.  Legitimate Interest. For our legitimate business interests. 

5.  Legal Obligation. To comply with our legal obligations or as may be required by law.

As we provide you with our Services, we will collect the following Personal Data:

1.  Through our Site

When you visit our Site, you may choose to provide information to us, such as when you contact us to request or provide information through our “Apply Now” or “Contact Us” pages on the Site.

We may collect the following categories of information from our Site:

●  Name, Position Applying For, mobile number, email address, unique personal identifiers (cookies, IP address), (“Identifiers”).

2.  Through the Provision of our Recruitment and Processing Services

When we provide our recruitment and processing Services we may collect the following Personal Data of applicant or candidates: 

·  Personal Information, such as your name, photo, signature, residential, business or mailing address;

·  Contact information, such as your email address, telephone, mobile phone number;

·  Employment background and trainings, which includes but is not limited to employment history, occupation, salary, position or designation, contract duration; 

·  Personal characteristics, such as gender, nationality, height, weight and language spoken; 

·  Sensitive personal information, such as date and place of birth, marital status, religion, arrest record and conduct, affiliations or organizations, government issued identifiers (i.e. identification numbers for PAG-IBIG Fund (including Member Data Record), SSS, GSIS, TIN and PhilHealth, and copies of government issued IDs such as Passport), VISA, professional licenses or civil service eligibility;

·  Health data including medical report and health examination results; 

·  Personal data of your beneficiaries and dependents such as full name, address, age, date of birth, occupation, gender, marital status, status of employment; 

·  Information related to personal finances, such as bank account details, bank statements, taxation information and other relevant details needed for purposes of facilitating payments and taxes;

·  Records of your transactions, the content you have provided us with, your requests, your agreements with us and the services provided to you; 

·  Information that we would need to conduct due diligence for identity and legitimacy verification; and

·  Other information that may be collected from your interaction and use of our website.

When we provide our recruitment and processing Services we may also collect the following Personal Data of our clients or their representatives: 

·  Personal Information, such as your name, signature, business or mailing address;

·  Contact information, such as your email address, telephone, mobile phone number;

·  Financial data such as bank account details, bank statements, taxation information and other relevant details needed for purposes of facilitating payments and taxes;

·  Records of your transactions, the content of communications with us, records of your requests, your agreements with us and the services provided to you; 

·  Information that we would need to conduct due diligence for identity and legitimacy verification; and

·  Other information that may be collected from your interaction with us. 

3.  Through our Internal HR Activities

When we conduct our own hiring process, employee onboarding, compensation and benefits and employee record management, we may collect the following Personal Data of applicants or employees:

·  Personal Information, such as your name, photo, signature and residential;

·  Contact information, such as your email address, telephone, mobile phone number;

·  Employment background and trainings, which includes but is not limited to employment history, occupation, salary, position or designation, contract duration; 

·  Personal characteristics, such as gender, nationality, height, weight and language spoken;

There may also be instances when we may request data that is not enumerated above, in such a case, we will properly notify you. You are under no obligation to provide any such information. However, if you choose to withhold requested information, we may not be able to provide you with certain Services.

We may also collect information that does not identify you individually. This may include anonymous, aggregated, analytical or statistical data; usage statistics and other forms of anonymized data that we may get from your use of our Services or otherwise liaising with us.

SOURCES OF YOUR PERSONAL DATA

Most of the Personal Data we process is provided to us directly by you when: 

1. You avail of any of our recruitment and processing Services and submit application and supporting documents;
2. You browse or conduct transactions through our website; 
3. You contact us through email, our website or in person. Subject to applicable law, we may record your conversations or maintain a record of your communications with our staff, service support personnel or with other such contact points.
4. You accomplish and submit to us certain forms such as: POEA and OWWA’s Worker’s Information Sheet and OFW Information Sheet and the like.
5. You submit your resume and supporting documents for our internal recruitment.
6. You are hired as an internal employee, and we manage your 201 File and other employment records for employee management activities and processing of salaries and benefits. 
7. You subscribe to receive notifications, advertisements, updates, publications, or other marketing materials.

We may also collect your Personal Data from other sources such as:

1. Medical examination results submitted to us by our accredited medical clinics. 
2. Commercially or publicly available sources, government agencies and public information sharing facilities. 

OUR PURPOSE FOR PROCESSING

We only collect the Personal Data needed to perform our services, conduct our business and manage our internal human resource, specifically, we use your Personal Data for the following purposes:

1.  For the provision of our recruitment and processing Services:
   1. To conduct initial assessment of candidate qualifications and conduct job matching with the manpower requirements of our Clients. 
   2. To conduct candidate’s initial interviews and pre-qualification assessments.
   3. To conduct post-qualification activities for the candidates such as medical examinations, training and certifications and processing of candidate requirements with government institutions such as POEA, OWWA and DMW as required by law. 
   4. To maintain and administer candidate application which includes sending transaction updates, notice and other documents necessary for processing candidate application and for other purposes that would be necessary or beneficial for the candidate.
   5. To respond to your queries, comments, feedback, or requests and address your complaints and provide customer support. 
   6. To verify or ascertain your identity, uniquely identify you or your business and identify potentially fraudulent activity.
   7. To carry out obligations arising from any contracts entered into between you and AL Manaf. 
   8. To validate, verify and/or update your application and supporting documents and verify Personal Data from third parties such as your previous employers, government agencies.
2.  For our internal HR management:
   1. To facilitate your job application and assess your qualifications.
   2. To conduct onboarding activities and facilitate pre-employment assessments. 
   3. To process any of your requests related to your employment and to process your compensation and benefits. 
   4. To submit reports and records to other government regulatory agencies in compliance with our obligations as employer.
3. For marketing and advertising activities:
   1. To communicate with you regarding services, activities, programs, seminars, trainings, promotions, services, products or other offers.
   2. To provide information we think you may find useful or which you have requested from us.
   3. To provide you with the marketing materials of third parties which we think may interest you. 
4. For compliance with our legal obligations, regulatory requirements and for other legal purposes:
   1. To process any complaints, implement preventive measures and to investigate act, omission, or misconduct that would constitute a violation of your contract with Al Manaf and of the applicable laws. 
   2. To gather the necessary information required by law, record keeping and good business practices.
   3. To comply with regulatory requirements of POEA, OWWA and DMW. 
   4. To protect Al Manf’s lawful rights and interests in court proceedings and to establish, exercise or as defense from legal claims.

As of the latest date of the Privacy Notice:

●  We DO NOT process personal information for the purposes of targeted advertising;

●  We DO NOT sell your personal information in exchange for monetary or other valuable consideration (Please note that we do not “sell” any of your personal information in exchange for money. However, the term “sell” has a broader meaning under applicable Data Privacy Laws than would ordinarily be understood in a non-legal context. We share your personal information to third parties for business purposes such as to service providers for performance of the services, for regulatory compliance, service improvement and quality management);

●  We DO NOT engage in automated profiling based on your personal data that produce legal or similarly significant effects concerning you. Our candidate assessment and profiling is manually done, where our team assess your qualifications based on your application and supporting documents submitted. 

DATA DISCLOSURE AND SHARING

In the course of your transaction with us, we may disclose and share your Personal Data to the following:

1.  To third-party service providers engaged by us who process personal data on our behalf as a result of the service they perform. These service providers will only process your Personal Data upon our instructions.

1. To law enforcement agencies, government authorities, or other third parties if we believe your actions are inconsistent with our contracts or policies, or if we believe there is a need to protect the rights, property, or safety of Al Manaf, our Clients and Candidates. 
2. To government institutions regulating international recruitment of Filipino workers such as POEA, OWWA and DMW as required by law or to comply with our legal obligations. 

Rest assured that, in sharing your personal data, Al Manaf will ensure that your rights as a data subject are protected and respected. We will only share your Personal Data upon your consent, when necessary, or when allowed by the DPA and other relevant rules and regulations. We ensure the personal data being shared to the above listed recipients are not excessive in relation to the declared and specified purpose. 

PERIOD FOR DATA RETENTION

Electronic records are securely stored in local drives within our office. Physical documents, on the other hand, are stored and kept within our office in a secured storage facility. 

We will retain your Personal Data for as long as necessary to fulfill the purposes for which it was collected or as may be required by applicable law, rules and regulations. 

Once it is ascertained that the retention is no longer necessary, we will securely dispose your Personal Data in accordance with our internal procedure such as: shredding the physical records, deletion or purging of electronic data including its backups, and through such other means that would prevent further processing.

OUR DATA PROTECTION MEASURES

We implement reasonable and appropriate technical, physical and organizational security measures to protect your Personal Data from unauthorized disclosure, misuse, alteration, loss or destruction. 

While we cannot guarantee the absolute security and impenetrability of our database, we take all the necessary measures, according to reasonable industry standards and practices to keep your data safe through the establishment of security controls, such as, but not limited to:

1.  We implement data privacy and protection policies to provide standards and guidelines on how we handle personal data we process.

2.  We ensure that our data processing systems are secured against unauthorized access  through regularly review, monitoring and testing to ensure that the security and integrity of the system is not compromised.

3.  We regularly monitor security incidents and implement process for taking appropriate preventive, corrective and mitigating action; and

4.  We ensure that our employees, agents, vendors and anyone who is involved in the processing of your personal data shall operate under strict confidentiality.

YOUR ROLE IN DATA PROTECTION

While we try to keep our systems safe, we cannot control external factors (such as the safety of your computer or mobile phone, the network you are using, the servers you are being routed through, and the like). As our partner in safeguarding your Personal Data, we rely on your commitment:

1.  To employ the necessary measures to likewise protect your Personal Data, including keeping your passwords and security information safe and updated.

2.  To communicate with us only through our official support channels, while taking appropriate security and confidentiality safeguards necessary on your end.

YOUR DATA SUBJECT RIGHTS

Under the DPA, you have the following rights:   

1.  Right to be informed.  You have the right to be informed prior to data collection of how your data will be collected, used, stored, shared and disposed. We uphold this right through this Privacy Notice. 

2.  Right to object. You have the right to say no to our processing of your personal data or withdrawing the same thereafter.

3.  Right of access. You have the right to ask us information on how we process your Personal Data.

4.  Right to rectification. You have the right to ask us to modify or correct your personal data when the same is incomplete, inaccurate, outdated or false.

5.  Right to erasure or blocking.  You have the right to ask us to delete or block the use of your Personal Data, when there is no other existing basis for processing and retaining the same.

6.  Right to data portability. You have the right to ask that we provide a copy of your data to another organization, or to you, in certain circumstances.

7.  Right to file a complaint and ask for damages.
